Msichana wa kidato cha Nne mwenye umri wa miaka 17, (jina tunalo) anayesoma shule moja ya sekondari ya Kata mkoani Mbeya amekumbwa na kadhia ya kuchojolewa nguo zake za ndani na kucharazwa bakora zisizo na idadi na walimu wanne wa shule hiyo.

Tukio hilo ambalo limeripotiwa katika kituo kidogo cha Polisi Mbalizi wilaya ya Mbeya kwenye jalada la uchunguzi namba MBI/IR/967/2016 na kuwekwa kwenye taarifa yenye namba MBI/RB/2653/2016 linadaiwa kuwahusisha walimu wanne akiwemo Mkuu wa shule hiyo pamoja na walimu watatu.

Akizungumza huku akiwa na maumivu makali katika Hospitali Teule ya Ifisi ambako amelazwa akipatiwa matibabu, mwanafunzi huyo alisema kuwa aliitwa na mwalimu wa nidhamu aliyemtaja kwa jina la Neema Mwaikenda aliyekuwa pamoja na Mkuu wa shule hiyo aliyemtaja kwa jina la Mariamu Mwanisenga na mwalimu wa kiume aliyemtaja kwa jina la Adili.

Alisema walimu hao walianza kumuadhibu kwa viboko visivyo na idadi huku akiwa amechojolewa nguo zake ambapo mwalimu wa kiume aliyemtaja kwa jina la Adili akaanza kumshikashika sehemu zake za siri.
‘Wakati naadhibiwa na walimu wote, huyu mwalimu wa kiume alianza kunishika huku chini,na kunitaka niwataje wanaume zangu,nikawa nabana miguu wakazidi kunishambulia kwa vibao na mateke na fimbo,’alisema mwanafunzi huyo.
Alisema sababu zilizosababisha aadhibiwe ilikuwa ni utoro na kuwa siku moja alipokuwa shuleni alioneshwa na walimu fimbo na kuelezwa kuwa fimbo hizo zitamuishia mwilini ndipo akaogopa kufika shuleni kwa siku tatu.

Anafafanua kuwa siku aliyofika shuleni ndipo alipokutana na kadhia ya kupigwa na walimu wanne hadi alipowaponyoka walimu hao na kukimbilia mitaani na kujificha.
‘Niliwaponyoka walimu nikakimbilia kwenye nyumba ya jirani na shule nikajificha hadi jioni na baadaye kwenda nyumbani, kesho yake mama na dada walinichukua na kunileta hospitali,’’alisema.
Mwandishi wa habari hizi alifika shuleni anakosoma mwanafunzi huyo kwa nia ya kukutana na uongozi wa shuleni hiyo ambapo Makamu Mkuu wa shule hiyo aliyejitambulisha kwa jina moja la Mwansanga alikataa kuelezea chochote.
‘Mie sijui lolote kwanza mie sio msemaji wa shule, kwahiyo sijui lolote juu ya taarifa mnazohitaji,’alijibu Makamu Mkuu wa shule na kuondoka zake.
Kwa upande wake Ofisa Elimu wa Mkoa Charles Mwakalila alisema kuwa adhabu aliyopewa mwanafunzi huyo ni kubwa kupitiliza kwa kuwa zipo taratibu za adhabu kulingana na makosa na kuwa mwanafunzi anapaswa kupigwa viboko vitatu na viboko visivyozidi sita au adhabu mbadala.
‘dhabu aliyopewa ni kubwa, tutafuatilia na waliokiuka taratibu watachukuliwa hatua za kinidhamu,’alisema Mwakalila.
Naye Kamanda wa Polisi wa mkoa wa Mbeya Dhahiri Kidavashari alipoulizwa juu ya tukio hili alidai kuwa halijafika ofisini kwake na kuwa kwa sasa yeye yupo kikazi wilayani Chunya na mara atakapofika ofisini atafuatilia na kuchukua hatua za kisheria kwa wahusika wa tukio hilo.

Awali Katibu Tawala wa Mkoa wa Mbeya Mariamu Mtunguja ambaye alifika Hospitalini alikolazwa mwanafunzi huyo alisema kuwa amemuangalia mwanafunzi huyo na kuona namna ambavyo damu imevilia kwenye sehemu zake za makalio na kwenye mapaja.

Mtunguja alisema kuwa kitendo kilichofanywa na walimu hao ni cha kinyama ambacho hakipaswi kuvumiliwa na kuwa mara itakapobainika atahakikisha walimu hao wanachukuliwa hatua za kinidhamu.

Muuguzi Mkuu Msaidizi wa Hospitali Teule ya Ifisi Elimati Sanga alisema kuwa mwanafunzi huyo alifikishwa hospitalini hapo Julai 21 saa 7:00 mchana ambapo alipatiwa matibabu na kulazwa kutokana na majeraha na damu iliyovilia mwilini sehemu za makalio na mapaja.
‘Ameshambuliwa sehemu za mapaja, damu na masikio yake hasikii vyema kutokana na kipigo, anaendelea na matitabu hapa hospitali,’ alisema Sanga.

EPA has never made much sense for Tanzania


The EPA issue has resurfaced once again. Kenya has too much at stake on this deal but Tanzania’s former President, Benjamin Mkapa says the deal has never meant to his country.
Tanzania informed EAC Members and the EU that it would not be able to sign the Economic Partnership Agreement (EPA) between EU and the six EAC Member States in early July, claiming that after Brexit they weren’t sure of the stability of the EU.

Now, the East African nation says it has nothing to lose from foregoing the agreement.

The European Commission reportedly proposed signature of the EAC EPA in Nairobi, on the sidelines of the 14th session of the UN Conference on Trade and Development (UNCTAD XIV).

This is a major quadrennial event where all UN Member States negotiate guidance for UNCTAD, a UN institution working on trade and development. For the European Commission, it would have been a propitious place for a signature ceremony in order to project the EPA as a ‘trade and development’ agreement to the benefit of EAC. Yet, the agreement is antithetical to Tanzania’s as well as the region’s trade and development prospects.

The EPA for Tanzania and the EAC never made much sense. The maths just never added up, says Mr. Mkapa.

“The costs for the country and the EAC region would have been higher than the benefits. As a Least Developed Country (LDC), Tanzania already enjoys the Everything but Arms (EBA) preference scheme provided by the European Union i.e. we can already export duty-free and quota-free to the EU market without providing the EU with similar market access terms,” he added.

Mr Mkapa goes on to explain why Tanzania will not be considering the deal anytime soon

If we sign the EPA, we would still get the same duty-free access, but in return, we would have to open up our markets also for EU exports. Threats to domestic producers and industries The EPA is a free trade agreement.

Tanzania would reduce to zero tariffs on 90% of all its industrial goods trade with the EU i.e. duty-free access on almost all EU’s non-agricultural products into the country.

Such a high level of liberalisation visà- vis a very competitive partner is likely to put our existing local industries in jeopardy and discourage the development of new industries. Research using trade data shows that Tanzania currently produces and exports on 983 tariff lines (at the HS 6 digit level).

(The EU produces and exports on over 5,000 tariff lines). When the EPA is implemented, 335 of the 983 products we currently produce would be protected in the EPA’s ‘sensitive list’, but 648 tariff lines would be made dutyfree; i.e. the existing industries on these 648 tariff lines would have to compete with EU’s imports without the protection of tariffs. Will these sectors survive the competition?

These 648 tariff lines – thedomestic sectors or industries, which are likely to be put at risk include agricultural products (e.g. maize products, cotton seed oil cake); chemical products (e.g. urea, fertilisers); vehicle industry parts (tires);medicaments; intermediate industrial products (e.g. plastic packing material, steel, iron and aluminium articles, wires and cables); parts of machines and final industrial products (e.g. weighing machines, metal rolling mills, drilling machines, transformers, generating sets, prefabricated buildings etc); parts of machines (parts of gas turbines, parts of cranes, worktrucks, shovels, and other construction machinery, parts of machines for industrial preparation/ manufacturing of food, aircraft parts etc).

The list does not stop here. Liberalisation (zero tariffs) also applies to the many industrial sectors that Tanzania and the EAC do not yet have existing production/exports – about 3,102 tariff lines for Tanzania.

Threatening Regional Industrialisation and Trade

Statistics show that in fact, for the EAC region, the African market is the primary market for its manufactured exports. In contrast, 91% of its current trade with the EU is made up of primary commodity exports (agricultural products such as coffee, tea, spices, fruit and vegetables, fish, tobacco, hides and skins etc).

Only a minuscule 6% or about $200,000 of EAC exports to the EU is composed of manufactured goods.In contrast, of the total EAC exports to Africa, almost 50% is made up of manufactured exports – about $2.5 billion – according to 2013 – 2015 data. Of this, $1.5 billion are EAC country exports to other EAC countries.

These figures tell two stories: One; the importance of the African market for EAC’s aspirations to industrialise. In contrast, the EU market plays almost no role in this.Two; the EAC internal market makes up 60% of EAC’s manufactured exports to Africa, i.e., the EAC regional market is extremely valuable in supporting EAC’s industrialisation efforts.

The EPA would threaten this regional industrialisation opportunity that is currently blossoming since most EU manufactured products would enter the EAC market dutyfree. Just as our manufactured products are not competitive in the EU market, even though they can be exported dutyfree, might it not be the case that when EU manufactured products can come duty-free into the EAC market, EAC manufactured products may also not sell? The EPA could in fact destroy our economic regional integration efforts.

The pains EAC has taken to build a regional market may instead help serve EU’s commercial interests by offering the EU one EAC market, rather than ensuring that that market can be accessed by our own producers.

Removing an Important Industrialisation Tool – No New Export Taxes

The other area where the EPA hits the heart of our industrialisation aspirations are its disciplines on export taxes. At the WTO, export taxes are completely legal.The logic of export taxes is to encourage producers to enter into value-added processing, hence encouraging diversification and the upgradation of production capacities. Developed countries themselves had used these policy tools when they were developing.

The EU has a raw materials initiative aimed at accessing non-agricultural raw materials found in other countries. According to the European Commission, ‘securing reliable and unhindered access to raw materials is important for the EU. In the EU, there are at least 30 million jobs depending on the availability of raw materials.’ In implementing this initiative, the EU has used trade agreements to discipline export taxes.

The EPA prohibits signatories from introducing new export taxes or increase existing ones. For Tanzania and the EAC region with its rich deposits of raw material, including tungsten, cobalt, tantalum etc; such disciplines in the long-run would be incongruent with our objective to industrialise and add value to our resources.

Losing Important Tariff Revenue – Shrinking the Government Coffer

The other area of loss resulting from the EPA is tariff revenue, and the numbers are not small. Conservative estimates (assuming import growth of 0.9% year on year) show that for the EAC as a whole tariff revenue losses would amount to $251 million a year by the end of the EPA’s implementation period Cumulative tariff revenue losses would amount to USD 2.9 billion in the first 25 years of the EPA’s life.

For Tanzania, the losses based on 2013–2014 import figures are about $71 million a year by year 25. Cumulatively, just for Tanzania, they come up to $700 million over the first 25 years.

Where is the Promised Development Aid?

EU has made many promises that the EPA would be accompanied by development assistance. Hence the EAC EPA incorporates a ‘Development Matrix’ containing a list of economic development projects for the EAC. The price tag of implementing this Development Matrix is $70 billion.

The Matrix and assistance is to be reviewed every 5 years. For the time-being, the EU has pledged to contribute a paltry $3.49 million, which translates into 0.005% of the total required funds!This is also a far cry from the tariff revenue losses the region faces –the $251 million a year mentioned above.

EPA to safeguard Kenya’s flower Industry – A Fair exchange?

The only area where the EPA is supposed to serve the interest of the EAC is by providing duty-free access to Kenya. As a non-LDC, Kenya does not have duty-free access via the EU’s EBA. Kenya’s main export item to the EU is flowers – just over $500,000 a year.

Without the EPA, Kenyan’s flowers would be charged a 10% customs duty. There are other Kenyan exports also –vegetables, fruit, fish – that will face tariffs. However, the flower industry has thus far been the most vocal. Nevertheless, all in all, Kenyan exports to the EU market (including the UK) amounts to about $1.5 billion.

If no EPA is signed, the extra duties charged to Kenyan exports amounts to about $100 million a year. Is this worth signing an EPA for? — The avoidance of duties of $100 million? The tariff revenue losses as the EPA is implemented (and more tariff lines are liberalised) would be comparable.

This does not even include the tariff revenue losses of the other EAC LDCs, nor the challenges posed to domestic/ regional industries. In addition, the Brexit development is further reason for the region to pause and reconsider.

The UK is a major export market for Kenya, absorbing 28% of Kenya’s exports to the EU. This reduces the EPA’s supposed ‘benefits’ by a quarter for Kenya. There is a possible solution for Kenya – to apply for the EU’s Generalised System of Preferences Plus scheme (GSP+). Under this, almost all of Kenya’s current exports could enter EU duty-free including flowers and fish.

This option could be explored. Alternatively all EAC countries would do well to attempt to diversify production and exports away from primary commodities towards value-added products, and also to diversify our export destinations. Africa is a critical market for EAC’s manufactured goods. Regional integration and trade is the most promising avenue for EAC’s industrial development. The EPA would derail us from that promise.

Tanzanian shilling stabilizes

The Bank of Tanzania (BoT) has said their strategy to stabilize the shilling against major currencies paid off.

The shilling at the moment wobbling between 2,180/- and 2,200/- against the US dollars quoted by commercial banks which was still good for exporting business.

BoT Governor Prof Benno Ndulu said the shilling was stable since the beginning of this year, a good trend for import and export traders. 
“You can see now the shilling is stable,” Prof Ndulu told ‘Daily News’ recently.
He added: 
“the level is good as it support exports business… if it goes down (to say 1,500/) will hurt exports.” 
The current level between shilling and dollar favours’ exports since the country goods and services are sold at discount as few dollars get many shillings.

The BoT data show that the shilling has depreciated by 1.35 per in the last six and half months to 2,179/72 as of yesterday. CRDB bank said yesterday that the shilling continued to gain against the greenback closing at 2181/91.
“We expect the shilling to remain strong following an increase in the demand for the local currency as corporates meet month end obligations,” the bank said on it daily market report.
Another bank, NMB, said the shilling gained slightly on Tuesday against the dollar amidst moderate demand from SMEs and other importers. 
“Market has experienced good support from agriculture inflows, liquidity tightness and less demand from the larger importers,” 
NMB said.

Since the beginning of this month the shilling enjoyed good days’ trend after appreciating against British pound and somewhat maintaining levels with the US dollar.

The local currency, appreciated against pound sterling some 70/- to 2,878/34 in the last three weeks. It also maintained its levels against the greenback after slightly dropping by almost 30 cents to 2,190/19 per one dollar.

Vetting process in Tanzania: JKCI excludes Form IV, VI certificates

Dar es Salaam — The director of Jakaya Kikwete Cardiac Institute (JKCI), Prof Mohammed Janabi, said yesterday that his institution would not consider secondary school certificates during a vetting process for public servants.

Instead, it would focus on professional certificates for undergraduate and post-graduate courses in an effort to crack down on ghost workers. "I am not against the government's plan to crack down on ghost workers, I wouldn't wish to penalise a medical doctor, who officially went through all academic ranks, but only failed during his O-Level exams," he said.

Prof Janabi was speaking during a meeting that brought together staff members of JKCI and Muhimbili National Hospital to discuss the welfare of health care professionals.

His remarks come at a time, when the ministry of Public Service Management and Good Governance has ordered all institutions in the government to remove ghost workers, who are costing the government billions of shillings every month.
"There is an outcry in the country for a shortage of human resources. If I would just penalise a medical doctor, who has studied up to Master's Degree for under-performing during his/her secondary school exams, that would be like adding a burden to another burden," he further noted.
The don, who was former President Jakaya Kikwete's personal physician, noted that it was high time health care professionals formed a strong trade union that would help address the challenges in their field.

The chairperson of the Tanzania Medical Dental and Pharmaceutical Workers Union, Dr Raymond Mwenesano told the meeting that trade unions were a better option as organs that could negotiate with the government and protect their interests as workers, than professional bodies.

1.0 UTANGULIZI

Kamati Kuu ya dharura ya Chama iliketi kuanzia tarehe 23-26 Julai, 2016 Jijini Dar Es Salaam na ilikuwa na ajenda moja mahsusi ambayo ni kujadili hali ya siasa na uchumi wa Taifa tangu serikali ya awamu ya tano ilipoingia madarakani mwezi Novemba, 2015.

Mwenendo wa serikali hii ya CCM ya awamu ya tano, chini ya Rais John Magufuli, ni dhahiri kuwa umeamua kuiweka demokrasia kizuizini na kuleta utawala wa Kidikteta katika nchi yetu.

2.0 MATUKIO MAHSUSI YA UKANDAMIZAJI WA HAKI NA DEMOKRASIA NCHINI

2.1 Kupiga Marufuku Mikutano ya Vyama vya Siasa: Serikali kupitia Waziri Mkuu na hatimaye Rais na jeshi la Polisi walitangaza kwa nyakati tofauti kwamba ni marufuku kwa vyama vya siasa kufanya mikutano ya kisiasa mpaka mwaka 2020 ili kuipa Serikali nafasi ya kufanya kazi. Huu ni uvunjaji wa Ibara ya 20 (1) ya Katiba.

Aidha, katazo la mikutano ya siasa linakiuka Sheria namba 5 ya Vyama vya siasa ya mwaka 1992 kifungu cha 11 ambayo imetoa haki kwa vyama vya siasa kufanya kazi ya siasa.

2.2 Kupiga Marufuku Urushwaji wa moja kwa moja (live coverage) wa Mijadala ya Bunge: Katazo hilo ni kinyume na Katiba ibara ya 18 ya Jamhuri ya

Muungano wa Tanzania ambayo inatoa uhuru wa maoni na uhuru wa kupata habari kwa kila mwananchi.

2.3 Kudhibiti Wabunge wa Upinzani Bungeni: Serikali imejificha nyuma ya kiti cha Naibu Spika wa Bunge, Dkt. Tulia Ackson Mwansasu (Mb) ili kuwadhibiti Wabunge wa Upinzani Bungeni kwa lengo la kuwanyamazisha wasiikosoe Serikali.

Ikumbukwe kwamba Dkt. Tulia akiwa Naibu Mwanasheria Mkuu wa Serikali alikuwa ni mtumishi wa umma asiyepaswa kuwa mwanachama wa chama chochote cha siasa; lakini ghafla anaonekana akigombea nafasi ya Naibu Spika kupitia CCM. Hivyo yupo Naibu Spika ambaye ni mteule wa Rais. Swali: Anawajibika kwa nani kati ya Bunge na Rais?

2.4 Kuingilia Mhimili wa Mahakama: Serikali ya CCM kupitia Rais, kwa nyakati tofauti imeonekana kujaribu kuingilia uhuru wa Mahakama jambo ambalo ni hatari kwa utoaji wa haki nchini. Katika hotuba yake, wakati wa maadhimisho ya siku ya sheria duniani Rais alinukuliwa akisema kwamba Mahakama iwahukumu harakaharaka watu waliokwepa kodi halafu atatumia asilimia fulani ya fedha ambazo zitakuwa zimepatikana kutokana na faini za wale walioshindwa kesi kuwapa Mahakama.

2.5 Kupuuza Utawala wa Sheria: Tarehe 24 Juni, 2016 wakati wa uzinduzi wa siku ya usalama wa raia, Rais Magufuli alinukuliwa akiwaruhusu polisi kuwaua majambazi bila kuwafikisha mahakamani ili sheria ichukue mkondo wake. Aidha aliuagiza uongozi wa Jeshi la Polisi kuwapandisha vyeo watakaowauwa majambazi.

2.6 Muswada wa Sheria ya Haki ya kupata habari –Serikali imepeleka Bungeni Muswada wa Sheria ya Haki ya kupata habari. Sheria hii imeweka adhabu kubwa sana kwa waandishi kama vile kifungo cha miaka 15 na kisichozidi miaka 20 kwa mujibu wa kifungu cha 6(6)

2.7 Serikali hii inatishia ukuaji wa uchumi

Tangu serikali ilipoingia madarakani hali ya ukuaji wa uchumi na hata uwekezaji wa mitaji imekuwa ikiporomoka kwa kasi kubwa sana nchini mwetu na hata baadhi ya wawekezaji wanaondoa mitaji yao kutokana na serikali hii kukosa mwelekeo unaoeleweka wa Kiuchumi.

2.8 Serikali za mitaa kunyanganywa mapato na serikali kuu.

Baada ya uchaguzi Mkuu wa mwaka 2015 tulifanikiwa kushinda maeneo ya Majiji ya DSM, Mbeya,Arusha na Miji mikubwa ya Iringa, Moshi,Bukoba,Babati,Tunduma na mingineyo ya maeneo ya mijini ambayo kwa kiasi kikubwa wanategemea sana kuendesha Halimashauri hizo kwa kutumia kodi ya Majengo Kodi ya Majengo inachangia kati ya 30% hadi 60% ya mapato ya ndani ya Mamlaka za Miji.

2.9 Diplomasia na mahusiano ya kimataifa

Hivi karibuni serikali imetoa maelekezo kupitia mawasiliano yake na Mabalozi (Note Verbale) kuelekeza kuwa kabla ya Mabalozi au maofisa wa Ubalozi kukutana na asasi zisizo za kiserikali au vyama vya siasa ni lazima kwanza waombe kibali cha serikali kupitia Wizara ya Mambo Nje.
Utaratibu huu unaminya uhuru wa mabalozi na wanadiplomasia mbalimbali kufanya kazi zao nchini na ni utaratibu ambao unakiuka utamaduni uliokuwepo awali na pia unakiuka masharti ya Mkataba wa Vienna kuhusu mahusiano ya Kibalozi Duniani.

2.10 Uteuzi wa Wakurugenzi wa Halimashauri

Uteuzi wa Rais wa Wakurugenzi wa Halimashauri na Makatibu Tawala wa Wilaya haukuzingatia sheria za utumishi wa umma na badala yake umezingatia kigezo cha Ukada zaidi badala ya weledi na historia katika utumishi wa umma kama ambavyo sheria zinataka, zaidi ya wakurugenzi 80 na Makatibu tawala zaidi ya 40 waligombea kura za maoni ndani ya CCM 2015.

2.11 ZANZIBAR

Kwa sababu ya hasira ya kukataliwa kwa CCM, vikosi vya ulinzi na hasa Jeshi la Polisi vimekuwa vikishiriki katika vitendo kadhaa vya ukiukwaji wa haki za raia huko Zanzibar ambapo kwa zaidi ya miezi miwili sasa, wamekuwa wakipita katika vijiji na kuwapiga, kuwatesa, kuwakamata, kuwatishia na hata kuharibu mali za wananchi na mifugo yao

Tunawataka wananchi wa Unguja na Pemba waendelee kuikataa Serikali haramu iliyopo madarakani huko Zanzibar kwa njia za amani.

3.0 MAAZIMIO YA KAMATI KUU

Baada ya majadiliano Kamati Kuu imeazimia ifuatavyo;

3.1 Septemba 1, siku ya mikutano ya hadhara nchi nzima
Kamati kuu imeagiza ngazi zote za chama kuanzia ngazi ya msingi, Kata, Majimbo, Wilaya, Mikoa, Kanda, Mabaraza na Taifa kukaa vikao vyake vya kikatiba na imeelekeza ajenda ya vikao hivyo kuwa ni kujadili hali ya siasa, hali ya uchumi na maandalizi ya mikutano ya hadhara ya tarehe 01 Septemba, 2016 nchi nzima.

3.2 Wanasheria wa Chama kuchukua hatua
Kamati Kuu imewataka wanasheria wa chama kukaa na kuyatazama mambo yote ambayo yametokea na kuchukua hatua za kisheria kwa lengo la kuyatafutia suluhisho la kisheria.

3.3 OPERESHENI UKUTA

UMOJA WA KUPAMBANA NA UDIKTETA TANZANIA (UKUTA)

UTANGULIZI

Kwa mujibu wa katiba ya Jamhuri ya Muungano wa Tanzania, katika utangulizi kuna maneno yameandikwa na ambayo yamekaziwa na sheria namba 15 ya mwaka 1984 ibara ya 3 na sheria namba 1 ya mwaka 2005 ibara ya 3. Katika utangulizi huo wa katiba yetu imeandikwa kama ifuatayavyo;

“KWA KUWA Sisi wananchi wa Jamhuri ya Muungano wa Tanzania tumeamua rasmi na kwa dhati kujenga katika nchi yetu jamii inayozingatia misingi ya uhuru, haki, udugu na amani”

“NA KWA KUWA misingi hiyo yaweza tu kutekelezwa katika jamii yenye demokrasia, ambayo Serikali yake husimamiwa na Bunge lenye wajumbe waliochaguliwa na linalowawakilisha wananchi na pia yenye Mahakama huru zinazotekeleza wajibu wa kutoa haki bila woga wala upendeleo wowote na hivyo kuhakikisha kwamba haki zote za binadamu zinadumishwa na kulindwa na wajibu wa kila mtu unatekelezwa kwa uaminifu:”

“KWA HIYO, BASI, KATIBA HII IMETUNGWA NA BUNGE MAALUM LA JAMHURI YA MUUNGANO WA TANZANIA kwa niaba ya Wananchi kwa madhumuni ya kujenga jamii kama hiyo na pia kwa ajili ya kuhakikisha kwamba Tanzania inaongozwa na Serikali yenye kufuata misingi ya Demokrasia ujamaa na isiyokuwa na Dini”

Aidha kwa mujibu wa Katiba ya Jamhuri ya Muungano wa Tanzana ibara ya 3 (1) inasema kuwa “Jamhuri ya Muungano ni Nchi ya Kidemokrasia na ya kijamaa, isiyokuwa na dini, yenye kufuata mfumo wa vyama vingi vya siasa”

Ni wazi sasa kuwa kuna tishio kubwa dhidi ya ukuaji wa Demokrasia hapa Nchini mwetu kutoka kwa viongozi wa serikali hii ya awamu ya tano kukandamiza Demokrasia na madhara ya kukandamizwa kwa demokrasia yameshaanza kulitafuna taifa letu.

Ni dhahiri kuwa kama raia wema tuna wajibu na haki ya kuilinda na kuitetea Katiba ya Nchi na kuhakikisha kuwa haivunji na yeyote na misingi ya Kidemokrasia ambayo ilijengwa kwa miongo mingi inaendelea kuimarika, kulelewa na kukuzwa mara dufu.

3. 4 KWANINI UKUTA NI MUHIMU!

Wakati wa Ufashisti wa Adolf Hitler huko Ujerumani unaanza kuchipua kabla ya kukomaa alianza kuchukua hatua mbalimbali za kuwanyamazisha Wajerumani kwa njia mbalimbali ili aweze kutawala kwa mkono wa Chuma.

Alikuwepo Mchungaji mmoja anayejulikana kwa jina la Martin Niemoller na ambaye alikuwa akimsemea Hitler kwa kila hatua ambazo alikuwa anachukua dhidi ya makundi mengine katika jamii ya wajerumani bila kujua kuwa lilikuwa ni suala la muda tu kabla hata yeye hajafikiwa na mkono wa Chuma wa Hitler.

Mchungaji huyu ni maarufu sana kwa msemo wake ambao aliutoa alipofikiwa na mkono wa Hitler ambao ulimpelekea kuishia jela kwa miaka 7 na wakati huo hapakuwa na mtetezi wa kumsemea, alisema hivi;

First they came for the Socialists, and I did not speak out— Because I was not a Socialist.
Then they came for the Trade Unionists, and I did not speak out— Because I was not a Trade Unionist.
Then they came for the Jews, and I did not speak out— Because I was not a Jew.
Then they came for me—and there was no one left to speak for me.

3.5 HALI TANZANIA IKOJE?

Tangu utawala wa awamu ya Tano ulipoingia madarakani mwezi Novemba, 2015 umechukua hatua mbalimbali za kubinya Demokrasia na kuua dhana ya utawala bora kwa njia mbalimbali.
Yapo makundi ya kijamii ambayo tayari yameshaumizwa au kubinywa na watanzania walio wengi wanakaa kimya kwa sababu wao sio sehemu ya kundi husika ambalo limenyimwa haki au kwa kuwa hajafikiwa moja kwa moja.

3.6 KWANINI NI MUHIMU KUJENGA UKUTA.
  • Rais alipiga marufuku safari za nje kwa watumishi wa umma- sikusema kwa kuwa mimi sikuwa mtumishi wa umma
  • Rais aliitaka mahakama kuu iwahukumu wafanyabiashara ambao wana kesi za kodi na serikali lazima ishinde-sikusema kwa kuwa sikuwa mfanyabiashara na wala sikuwa na kesi ya kodi
  • Serikali iliingilia Bunge na kupanga kamati za kudumu za Bunge-sikusema kwa kuwa mimi sikuwa mjumbe
  • Serikali ilizuia matangazo ya Bunge live-sikusema kwa kuwa mimi sio Mbunge
  • Wabunge wa Upinzani kunyanyaswa Bungeni na kuonewa –sikusema kwa kuwa mimi sio UKAWA
  • Hotuba za Upinzani kufutwa Bungeni kinyume cha Kanuni za Bunge –sikuwa mpinzani nilikaa kimya
  • Bunge kurejesha fedha zake kwa Rais kinyume cha sheria –sikusema kwa kuwa halinihusu
  • Tume ya Taifa ya Uchaguzi kurejesha fedha kwa Rais kinyume cha sheria –sikusema kwa kuwa Tume hainihusu
  • Serikali Kuwafukuza na kuwadhalilisha wanafunzi wa UDOM –sikusema kwa kuwa sina ndugu wala mtoto anayesoma UDOM.
  • Mikutano ya kisiasa kupigwa Marufuku –sikusema kwa kuwa mimi sio mwanasiasa
  • Wafanyabiashara kupelekewa bili kubwa za kodi na hata kuzuiliwa kwa Akaunti zao-sikusema kwa kuwa mimi sio mfanyabiashara
  • Uchumi unaporomoka kwenye sekta zote nchini -sikusema kwa kuwa mimi sijawahi kumiliki uchumi
  • Fao la kujitoa limeondolewa kwenye Mifuko ya hifadhi ya jamii, sikusema kwa sababu mimi si mwanachama wa mifuko ya hifadhi ya jamii.
  • Mashirika na Makampuni kuanza kupunguza wafanyakazi kutokana na kuporomoka kwa uchumi –sikusema kwa kuwa sijapunguzwa kazini
  • Mabalozi na wanadiplomasia kuzuiliwa kukutana na viongozi wa kisiasa bila kibali cha serikali- sikusema kwa kuwa halinihusu
  • Watumishi wa umma kulazimishwa kwenda kinyume na sheria na kanuni za utumishi wa umma wametakiwa kuwa Makada wa CCM –sikusema kwa kuwa mimi sio mtumishi wa umma
  • Ukaguzi wa vyeti vya kidato cha nne na kutumika kama msingi wa kufukuza watu kazi hata kama ni Maprofesa –sikusema kwa kuwa hawajaja kwenye sekta yangu
  • Watumishi wa umma kutumbuliwa majipu bila kufuatwa kwa sheria na kanuni za utumishi wa umma –sikusema kwa kuwa mimi sikutumbuliwa
  • Mawakili kuunganishwa kwenye kesi za wateja wao wanapoenda kuwatetea –sikusema kwa kuwa mimi sio wakili
  • Waalimu kukatwa mishahara iwapo dawati litavunjika kwenye shule yake –sikusema kwa kuwa mimi sio mwalimu
  • Kupotezwa kwa wana CCM ambao watapinga kauli ya Mwenyekiti au kuwa na maoni tofauti-sikusema kwa kuwa mimi sio mjumbe wa vikao vya CCM .
  • Muswada wa sheria ya haki ya kupata habari na adhabu ya kifungo cha miaka 15-20- sikusema kwa kuwa mimi sio mwandishi wa habari
  • Viongozi wa dini kudhalilishwa –sikusema kwa kuwa mimi sio kiongozi wa dini
  • Unyanyasaji na udhalilishaji wa wananchi Zanzibar –sikusema kwa kuwa mimi sio mzanzibari
3.7 TUCHUKUE HATUA!
i. Kwa kuwa wewe tayari umeshafikiwa hauna budi kujenga UKUTA ili kuzuia wengine wasidhurike na utawala huu.
ii. Kwa kuwa wewe hujafikiwa na ndio maana husemi wenzako wanapofikiwa, njoo tujenge UKUTA ili ukifikiwa awepo wa kusema
iii. Tuungane Tujenge UKUTA ili kuzuia uchumi wetu kuporomoka
iv. Njoo Tujenge UKUTA kuzuia Udikteta huu
v. Tujenge UKUTA tuilinde Katiba yetu
vi. UKUTA huu ni wa wananchi wote bila kujali dini, kabila, chama cha siasa au rangi
Historia inaonyesha kuwa Duniani pote Hakuna utawala uliwahi kuushinda UKUTA wa wananchi

Na hii ndio Nguvu ya Umma. Kila mmoja achukue hatua popote alipo ya kujenga UKUTA!

TAARIFA KWA VYOMBO VYA HABARI

Jana tarehe 27/7/2016 Chama Cha Demokrasia na Maendeleo (CHADEMA), walitoa kauli kwa Waandishi wa Habari kupitia Mwenyekiti wa Chama hicho Taifa Ndugu Freeman Mbowe (Mb). Tamko hilo kama ilivyo kawaida ya CHADEMA lilijaa uongo mwingi na ghiliba nyingi za kibabaishaji na kuthibitisha ukweli kuwa kwa hakika kutokana na kasi ya Serikali ya Awamu ya Tano chini ya Dr. John Pombe Magufuli wapinzani nchi hii wamekosa ajenda na hivyo njia peke yake wanayoona inafaa ili waendelee kufanya utapeli ni kutunga uongo, kujiaminisha katika uongo huo na kuusambaza uongo huo ili kujaribu kupata wafuasi.

Katika uongo na uzushi huo walioutangaza jana, CHADEMA wanasema wameamua kufanya mikutano na maandamano nchi nzima kwa tarehe waliyoitaja na maandamano hayo yatafanyika chini ya operesheni waliyoiita UKUTA. Kimsingi hoja walizozitumia kufikia uamuzi wao bila kuzirudia zimejaa upotoshaji na uongo uliokithiri. Kwa mfano wanadai Serikali imezuia mikutano yote ya vyama vya siasa, huku wakijua kuwa ni uongo kwani Serikali haijazuia mikutano kwenye majimbo yao, Wabunge wako huru kufanya shughuli zao kwenye majimbo yao, na tumeona Wabunge wakifanya shughuli zao majimboni bila shida wakiwemo hao wa vyama vya upinzani.

Lakini vyama vya siasa kufanya shughuli kwa mujibu wa katiba ya vyama vyao sio jambo lililozuiliwa pia, ndiyo maana tumeshuhudia vyama vikifanya mikutano yao ya kikatiba bila tabu.

Lakini mfano mwingine wa hoja za uongo na uzushi, ni hoja eti ya Serikali hii ya Awamu ya Tano kuwa ya kidikteta. Udikteta hasa unaosemwa na Chadema ni upi? Ni huu wa kushughulikia watumishi hewa? Ni huu wa kuwabana wakwepa kodi? Ni huu wa kupunguza na kudhibiti safari za nje? Ni huu wa kubana matumizi ya Serikali? Ni huu wa kufukuza wabadhirifu na wazembe kazini? Hivi udikteta huo ni huu wa kushughulikia mafisadi mpaka kuanzisha mahakama yao? CCM inaamini Watanzania walio wengi wanaunga mkono hatua zinazochukuliwa na Rais Magufuli na Serikali yake, sasa kama kwa Chadema hatua hizi ndiyo tafsiri yake ni udikteta basi bila shaka wao ni sehemu ya mfumo mbovu ndiyo maana wako tayari kuleta vurugu ili wautetee.

Kwa kuwa CHADEMA wamezoea kujenga Chama chao kwa harakati zinazohusisha kumwaga damu za Watanzania wasiokuwa na hatia, ukweli huu wa maelekezo ya Serikali hawausemi, isipokuwa wanafanya juhudi kubwa kuhakikisha wanafanya mambo ambayo mwisho wa siku yatasababisha vurugu, uvunjifu wa amani na umwagaji damu.

Lakini pengine ni muhimu Watanzania na wapenda amani nchini na duniani wakajiuliza ni kweli kuwa lengo la hizi vurugu na maandamano haya ni la kujenga na si kubomoa? Kwa nini kila operesheni ikifanywa na CHADEMA huwa inaambatana na umwagikaji wa damu za Watanzania wasiokuwa na hatia? Wakati wa Maandamano hayo inapotokea madhara ni kwa nini waathirika huwa sio viongozi waanzilishi wa maandamano hayo wala wake au waume zao au watoto wao au hata ndugu zao wa karibu bali huwa ni watu wengine nje ya hao ndugu zao wa karibu? Mpaka lini damu za Watanzania wasio na hatia zitaendelea kutumika kutafuta umaarufu wa CHADEMA na viongozi wake?

Hii ni kwa faida ya nani hasa? Kwa nini pamoja na kuelekezwa namna bora ya kufanya siasa wao huwa hawataki kufuata utaratibu? Hivi ni kweli kuwa hawajui bila kufuata utaratibu jambo lolote huwa ni vurugu?

Chama Cha Mapinduzi kinapenda kuwakumbusha Watanzania kuwa ni vizuri kutafakari na kujiuliza maswali ya msingi kabla ya kuamua kushiriki au kuruhusu watoto wetu kwenda kuwa kafara ya walafi wachache wa madaraka. Ni vizuri tukayakumbuka matukio kwenye operesheni kama hizi yaliyopoteza maisha ya vijana wetu na matokeo ya kila operesheni.

Pamoja na ukweli kuwa hakuna operesheni yeyote kati ya zote zilizowahi kufanywa na Chadema ambayo imewahi kuwasaidia Watanzania wa kawaida zaidi ya kujenga umaarufu wa viongozi wachache wa Chadema na kuneemesha matumbo yao na ya familia zao, operesheni zote zimepoteza maisha ya Watanzania kadhaa wasiokuwa na hatia wala wasiofaidika kwa lolote na operesheni hizo.

Kama nia ni njema kwa nini hawataki kufuata Sheria na taratibu tulizojiwekea? Demokrasia gani isiyokuwa na mipaka? Demokrasia bila mipaka ni fujo. Tunaomba vyombo vinavyohusika visisite kuchukua hatua zinazostahili bila kumuonea mtu lakini bila kufumbia macho vitendo vyenye lengo la kuwahujumu Watanzania waliowengi walioamua kuchapa kazi kuitikia wito wa Rais na Serikali ya Awamu ya Tano ya kufanya kazi.

Lakini pia tunawashauri Watanzania, wapenda amani, utulivu na maendeleo kupuuza wito wa vurugu na uvunjifu wa amani badala yake wajikite kwenye kuchapa kazi na kujitafutia maendeleo yao kwa kufanya kazi kwa bidii.

Maendeleo hayaji kwa maandamano, maendeleo huja kwa kuchapa kazi kwa bidii. Maendeleo hayaji kwa vurugu na fujo nchini, bali amani na utulivu ni vichocheo muhimu vya maendeleo ya kweli.
