Gazeti la MTANZANIA katika utafiti katika baadhi ya mikoa likiangalia vijana waendesha bodaboda wanapendelea nini zaidi katika kuongeza mbwembwe katika biashara zao, lilibaini kuwa ni maandishi yenye kuvutia katika mapepe ya pikipiki zao.

Kila mmoja anashindana na mwenzake kuweka jina alipendalo ambalo wakati mwingine humjengea umaarufu kupitia maneno hayo katika pepe.

Wasomaji wa vituko vya bodaboda hizo ni mbwembwe kwa baadhi ya mikoa lakini mikoa yote vijana wanaweka maneno katika mapepe. Maneno hayo wanayatumia katika maisha yao ya kila siku na yanaashiria kwamba waendesha bodaboda wengi ni vijana. 

Yako maneno mengi yanaandikwa yakiwa na maana kwa mwendeshaji wa bodaboda husika kama vile kuandika Jembe katika pepe lake. Nilipofuatilia nilibaini anajiona mshindi, ni mnywaji mzuri wa viroba na aliwahi kupata ajali akiwa amekunywa viroba. Kijana alirushwa na gari maeneo ya Mtoni Mtongani lakini alipokuja kuokotwa katika mtaro alikutwa akiwa hana jeraha. Aliondoka na bodaboda yake hadi Kiwalani, alijiona mzima hakufika hata hospitali japo pikipiki ilikuwa imeharibika sana. Kila alipokuwa akiulizwa kuhusiana na ajali yake alikuwa anamalizia na kibwagizo ‘mimi Jembe’ ndipo wenzie walipoanza kumuita hivyo. Kijana anasahau kwamba majeraha yanayoweza kuwa ndani na baadaye yakatokea madhara makubwa hasa kichwani.

Nyerere hakujifunza kuendesha gari, alijua kuendesha baiskeli


Kitabu chetu cha leo ni “Mlinzi Mkuu wa Mwalimu Nyerere,” kimeandikwa na Peter D. Bwimbo na kuchapishwa na kampuni ya Mkuki na Nyota. Kina nambari ISBN 9789987-753-32-1. Peter D. Bwimbo alikuwa afisa usalama wa taifa hivyo kuwa mlinzi mkuu wa Mwalimu Nyerere lilikuwa suala la utaratibu.

Mwandishi anatuachia kumbukumbu kuhusu maisha ya Mwalimu Nyerere na masuala ya ulinzi na usalama pamoja na maisha ya nyakati za ukoloni na baada serikali mpya ya Tanganyika (Tanzania) changamoto, mafunzo na maasi ya kijeshi ya mwaka 1964.

Kitabu hiki kinaeleza maisha ya makachero ama vyombo vya dola vinavyofanya kazi usiku na mchana kuhakikisha viongozi wetu wanaishi kwa amani na utulivu. Pamoja na changamoto za kuwalinda wananchi nchini kuanzia Special Branch (Idara ya Usalama wa Taifa kabla ya ukoloni) ambayo baadaye ilibadilishwa na kuitwa TISS (Tanzania Intelligence and Security Service).

Matukio muhimu yanayotajwa ndani ya kitabu hiki, 
“Kwa hiyo kazi ya kuwaelemisha wananchi kwa njia ya mikutano ya hadhara kuhusu masuala ya siasa na faida ya kujitawala ilikuwa ngumu sana iliyohitaji Mwalimu Nyerere na wenzake kujitolea kusafiri kwa shida umbali mrefu na kwa njia mbaya vijijini na mijini wakati mwingine kwa miguu kuwafikia wananchi mahali walipo. Aidha, wananchi nao wakati mwingine waliogopa kuhudhuria mikutano hiyo kwa hofu ya uwezekano wa kukamatwa na vyombo vya serikali ya kikoloni hata kama mikutano hiyo kwa bahati ilipewa vibali,” (Uk. Uk. 24).
Mwandishi anasema kulikuwa na nyakati ngumu za kupigania uhuru na baada ya wakoloni kuondoka. Baadhi ya maofisa wa kizungu walichukizwa na kupatikana kwa uhuru wakaamua kutotoa mafunzo yoyote.
“Maofisa Wazungu katika Special Branch (Idara ya Usalama) kabla hawajarudi kwao kufuatia program ya Africanisation (neno hilo lilitumiwa hivyo hivyo katika Kiswahili kuwa frikanaizesheni), hawakutayarisha mwongozo wowote ingawa kitengo hiki walikianzisha wenyewe. Kwa hiyo, wakati nakabidhiwa kushika madaraka haya nilielezwa tu na Tim Hardy kwamba nitaongoza kitengo hiki cha ulinzi wa waziri mkuu Julius Nyerere kuanzia mwezi Agostia 1961,”(Utangulizi uk. XI).
Aidha, 
“Tanganyika ilipata serikali ya madaraka ya ndani tarehe 3 Septemba 1960, wakati huo mimi bado nikiwa masomoni Uingereza. Baada ya TANU kushinda katika uchaguzi na kupata idadi kubwa ya wajumbe katika Barazala la Kutunga Sheria (Legco) Mwalimu aliteuliwa na Gavana kushika wadhifa wa waziri mkuu (Chief Minister) Special Branch wakati huo ilikuwa chini ya Jeshi la Polisi,” (Uk. 29).
Hii ina maana kuwa kabla ya Uhuru kamili, Tanganyika ilianza kwa kupewa serikali ya madaraka ya ndani (Internal self Government). Kwenye suala la kuwalinda viongozi, anasema “Ulinzi wa Mwalimu Nyerere kwa ujumla haukuwa rahisi, ikilinganishwa na ulinzi wa viongozi wengine, kwa sababu alijiamini kuhusu maisha yake ya kisiasa kiasi cha kutokuwa na wasiwasi,” (Uk.33).

Nyerere alikataa sanamu yake kuweka katikati ya jiji. 
“Mara baada ya uhuru, Halmashauri ya Jiji la Dar es Salaam wakati huo walitaka sanamu yake itengenezwe ichukue nafasi ya ile ya asakri wa vita mwenye bunduki na singe katika maungano ya Mtaa wa Samora, Azikiwe na Makunganya, alikataa kata kata kwa maelezo kuwa sanamu kama hizo hazifai katika nchi zinazozingatia demokrasia na kuongozwa kwa utaratibu wa kupokezana madaraka muda unapokwisha,” (Uk.39).
Mnamo Januari 22, 1962, Mwalimu Nyerere alipotangaza kujiuzulu wadhifa wake wa uwaziri mkuu kwa madai hakuwa akisikilizwa na serikali ya wakoloni. Baada ya kujiuzulu, alimteua Rashid Kawawa kuwa Waziri Mkuu (Uk.45).

Kuhusu maisha binafsi, kwa mfano, kabla ya uhuru palikuwa na Mwafrika mmoja tu nchini Tanganyika aliyekuwa na Digrii ya Masters aliyoipata mwaka 1952, miaka tisa kabla ya uhuru. Kulikuwa na madaktari Waafrika 12 pamoja na wahandisi Waafrika wawili wakati ambapo idadi ya watu wote nchini Tanganyika wakati huo ilikadiriwa kuwa milioni nne. Idadi hii ya wasomi nchini Tanganyika wakati huo alitajwa na Mwalimu Nyerere jijini Brasilia, Brazil tarehe 18 septemba 1996 katika hotuba yake aliyotoa kuhusu hali ya Afrika katika kipindi cha kuelekea karne ya 21. Mtu pekee Tanganyika aliyekuwa na digrii ya masters alikuwa yeye Mwalimu Nyerere lakini kwakuwa hakuwa mtu wa majivuno hilo hakulitaja,” (Uk.55).

Linalovuta hisia zangu ni hili, 
“Yeye mwenyewe Mwalimu Nyerere ameongoza nchi hii kwa muda mrefu lakini kadri ninavyofahamu, hakuweza kumiliki hata gari moja hadi anang’atuka kutoka ngazi ya urais wala hakujifunza kuendesha gari, bali alijua kuendesha Baiskeli,” (Uk.60).

Role Purpose:

Work closely with local implementing partners, SC Child protection staff, and members of the Education sector working Group, UNHCR and other UN agencies, to strengthen technical quality of education programme and ensure that the programme goals are achieved. The Education currently aims to provide learning opportunities for out of school Burundi refugee children and their parents in refugee camps in north west The post holder will be required to provide overall field-level technical leadership for the sector, and ensure that SC's vision and overall program goals related to the sector are met. He/She is responsible for contributing to proposal development in line with SC goals and strategic directions. He/She is responsible for providing managerial, technical, and administrative support to partner staff during the implementation of an integrated program. For purposes of ensuring healthy collaboration between SC's response and other actors in refugee education/protection, the officer will actively participate in education-related activities and meetings.

Qualifications and Experience
  • University Degree in Education, Social Sciences or related technical field.
  • Two years progressive experience in implementation of Alternative Education programmes, refugee education, non-formal education, Life skills or related field.
  • Previous experience in working with teacher training programs, vocational training programs or Accelerated Learning Programs (ALP) is desirable.
  • Previous experience working in Early Childhood Care and Development
  • Excellent Computing and data management skills.
  • Ability to adapt and work effectively in remote areas, work in a challenging work environment.
  • Ability to take personal responsibility for completing tasks to a high standard and to meet
  • Willingness to work flexibly and professionally in a dynamic and fast-moving
  • Fluency in English
  • Fluency in Kirundi
  • Previous experience working in refugee settings
  • Familiarity with the Burundi education system

Ndoa za utotoni: Waziri wa Sheria atamka sababu serikali kukata rufaa

Wakati vuguvugu la kupinga hatua ya Serikali kukata rufaa dhidi ya hukumu iliyotolewa na Mahakama Kuu kutaka umri wa kuolewa uongezwe hadi miaka 18, Waziri wa Katiba na Sheria, Dk Harrison Mwakyembe amesema wamefikia uamuzi huo ili kupata uamuzi wa Mahakama ya Rufani ambao hautaweza kubadilishwa na hivyo kuwa kama Sheria.

Dk Mwakyembe amesema Serikali haipingi uamuzi hukumu iliyotolewa na Mahakama Kuu, ila inatumia utaratibu wa kawaida utakaoiwezesha Serikali kuwa na uamuzi kutoka chombo cha juu cha Mahakama nchini. Alisema chombo hicho kikitoa uamuzi hautaweza kutenguliwa na mtu au chombo chochote.

Hivi karibuni, Mahakama Kuu Kanda ya Dar es Salaam ilitoa hukumu ambayo ilisema vifungu namba 13 na 17 vya Sheria ya Ndoa ya mwaka 1971 vinavyoruhusu mtoto wa kike aolewe akiwa na umri wa miaka 14 au mzazi kubariki ndoa akiwa na miaka 15, vinapingana na Katiba. Kesi hiyo iliyokuwa imefunguliwa na mwanaharakati, Rebecca Gyumi na kusimamiwa na Mwanasheria, Jebra Kambole ulivuta hisia za wengi za kutengeneza historia mpya ya kumlinda mtoto wa kike nchini.

Utawala wa sheria vs Sheria za utawala

Sakata linaloendelea kati ya Serikali na CHADEMA ni kilelezo cha wazi cha kutamalaki kwa sheria za utawala, badala ya utawala wa sheria nchini Tanzania.

Katika nchi ya kidemokrasia, ainisho la utawala wa sheria linasema utawala wa sheria ni hali ya kuweko vizuizi vya kisheria kuzuia maamuzi ya kiimla na udhibiti wa kisheria kwa ajili ya kumlinda mwananchi na kuwepo utaratibu na uwazi wa kisheria.

Katika nchi yenye utawala wa sheria huwezi kukuta mgongano kati ya sheria na maamuzi au matamko ya viongozi.

Kwa mfano, huwezi kukuta sheria inaruhusu vyama vya siasa kufanya mikutano ya kisiasa, huku viongozi wanaweka mpaka wa mikutano hiyo kwamba ifanyike katika maeneo ya viongozi husika tu au nyakati za uchaguzi pekee.

Viongozi wa vyama vyote vya siasa wako huru kwenda mahali popote pale katika nchi kufanya shughuli za kisiasa iwe ni kukutana na wanachama wao katika mikutano ya ndani au kukutana na wananchi katika mikutano ya hadhara.

Si busara hata kidogo kuwazuia viongozi wa vyama vya siasa wa kitaifa au hata kama si wa kitaifa kwenda sehemu yoyote ya nchi kufanya siasa, kwa sababu hiyo ndiyo kazi ya viongozi na chama cha siasa.

Utawala wa sheria maana yake ni kuhakikisha kutumika kwa sheria kama zilivyokusudiwa na siyo kuzipa tafsiri waitakayo watawala. Kufanya hivyo ndiko kunakohakikisha kwamba haki za wananchi zinalindwa na haki za watawala pia zinalindwa.

Kinyume cha utawala wa sheria ni kile kiitwacho ‘sheria za utawala’au kwa Kiingereza; ‘Law of rule’. Hali hii hutokea pale ambapo utawala unatoa amri zake kinyume cha sheria hali ambayo hukaribisha upinzani kutoka kwa wananchi.

Tangu Rais Magufuli aingie madarakani, kumekuwa na malalamiko kutoka kwa wananchi wa kada mbalimbali kwamba nchi yetu imeanza kubobea kidogo kidogo kwenye sheria za utawala.

Wataalamu wa mambo ya sheria na katiba wanasema kukosekana kwa utawala wa sheria na kutamalaki sheria za utawala, ni hali inayoweza kujitokeza katika nchi zote, zile za kidemokrasia na hata zile za kidikteta.

Ndiyo maana wakaja na msamiati “dictatorial democracy” yaani demokrasia ya kidikteta au ya kiimla kwa lugha nyepesi. Kinachoendelea katika nchi yetu hii ya kidemokrasia ni sheria ya utawala badala ya utawala wa sheria.

Minister suspends two TANESCO Managers

The Deputy Minister for Energy and Minerals, Dr Medard Kalemani, has suspended two project managers of new Kurasini Sub-Station for negligence and has ordered for fresh recruitment of others to accomplish the installation of the sub-station, reports the Daily News (Tanzania).

In line with this, Dr Kalemani ordered officials with Tanzania Electric Supply Company (TANESCO) to shun 'business as usual' mentality and get into serious work. He warned that the government will not hesitate to flush out such officers over laxity.

He made the move yesterday in Dar es Salaam when he made a surprise visit at Kurasini, Mbagala and Gongo la Mboto sub-stations to inspect the progress of setting up the power utilities designed to stabilise power supply in Dar es Salaam.

While at Kurasini Sub-station, Dr Kalemani ordered the Tanesco Project Manager, Eng Emmanuel Manirabona, to submit to him a report by next Tuesday explaining why the setting up of the sub-station of Kurasini has been delayed beyond scheduled time.

When asked to give the names of the suspended project managers, Eng Marinabona said he could not reveal the names as the managers were not at their sites. The installation of Kurasini sub-station project, which kicked off in February 2012, was expected to be completed in August 2013.

"Two site managers of the sub-station (Kurasini) should be suspended immediately from work and get others to accomplish the installation of the utility. And I want you (Tanesco Project Manager) by next Tuesday to submit a report for failure to complete the work as planned," he said.

He added that the ministry would also investigate the funds allocated to the project. Dr Kalemani ordered the suspension of the two managers after he found that no work was in progress at the site, despite having visited the area (Kurasini sub-station) early February, this year and ordered for quick accomplishment of the power utility.

Eng. Manirabona told Dr Kalemani that the installation of the utility has been delayed due to various challenges including lack of installation materials - an excuse that Dr Kalemani turned-down. He ordered that the utilities (Kurasini, Gongo La Mboto and Mbagala) be ready by the end of September, this year.

He said that 50 per cent of the project has been completed as the rest awaits installation materials that are expected to arrive on December 26, this year and that 80 per cent of payments have already been made to the site constructor.

Dr Kalemani said that the accomplishment of the power utilities is expected to end electricity blackouts and stabilise electricity supply in Dar es Salaam. He ordered Eng Manirabona to ensure that the utilities are fully accomplished by September or he faces legal sanctions. In another development, Dr Kalemani expressed the need for Tanesco officials to abstain from staying into their offices and instead go to work sites and serve customers as required.

"It is very disappointing to see the project that was planned to be completed in 18 months time delaying for negligence. Nothing is being done. The managers are not present," he said while looking disappointed.

He said Tanesco should avoid 'doing businesses as usual' but instead embark on serious matters, working on the sites to provide services to customers. He blamed the officials for staying in their offices, abandoning development projects and other important services.

This anomaly, he said, delays development of projects and thus causing electricity problems in the city and elsewhere. "All the officials with Tanesco in the country should know this. From today onwards, they should go out of their offices and start working in their respective sites to provide services to customers," he noted.
