Indian Ranch owner, Harrington executive help build hospital in Tanzania

A businessman and a hospital executive in southern Worcester County are helping a Springfield doctor's dream of building a hospital in her native Tanzania.
Christopher Robert, president of Webster Ventures' Indian Ranch campground and concert venue, contributed about $106,000 to bring clean and safe water and electricity to the village of Gera in the town of Bukoba of the Kagera region of Tanzania. The hospital aims to serve Kagera's more than 2 million inhabitants.

Dr. Mary Banda is building the hospital after having already built an elementary school and clinic in the impoverished African nation.

Dr. Banda, who practices internal medicine, is president and founder of Jambo Tanzania Inc., a nonprofit humanitarian organization of volunteers founded in Springfield in 1998.

The organization rebuilt the elementary school in the African village, whose high rate of AIDS has left many children orphans.

The water project will be finished in the coming weeks, and it will be the first time the area will have running water, Dr. Banda said Friday.

After Jambo Tanzania built the school, the Tanzanian government built a secondary school in the area. As a consequence of no clean water, Dr. Banda said, schoolchildren and area inhabitants are subject to waterborne diseases such as gastroenteritis, dysentery and cholera.

Edward H. Moore, president and CEO of Harrington Healthcare Systems, said the system is donating 30 hospital beds it was going to get rid of, and medical supplies. It will be a huge benefit to them, he said.

Mr. Moore said Dr. Banda told him about her goal of building a hospital, "which is right up my alley," during a meeting about her organization's mission work. Dr. Banda works at Mercy Medical Center.

Dr. Banda and a group of volunteers hold two-week medical clinics in Tanzania every other year. The clinics see up to 2,000 patients. Dr. Banda said she can't say enough about the volunteers, who pay their own way and treat patients for free.

Among this year's eight volunteers who are departing Wednesday is Mr. Moore's 21-year-old daughter, Alexandra Babineau, a pre-med student at the State University of New York in Albany.

Mr. Moore recently attended a meeting at which Dr. Banda discussed the volunteer clinic and what she called her "piecemeal" effort in building the hospital, whose exterior has been framed and is in need of a roof.

Impressed with Dr. Banda, and familiar with Mr. Robert and his philanthropic leanings, Mr. Moore said he reached out to Mr. Robert to tell him about the project.

Mr. Moore said Mr. Robert expressed interest and asked to meet Dr. Banda. When Mr. Moore asked when the meeting should take place, Mr. Robert said, "Tomorrow."

Mr. Robert drove to Springfield the next day.

Dr. Banda said: "When I talked to Chris about it, I thought water would be a huge gift to not only the students, but the village." She said it will be "a life-changing experience."

In addition to drilling the well and building a water-storage facility to pipes into the two local schools and hospital, the water has to be pumped to the different locations.

The government will put high-voltage power into utility poles, but Mr. Robert had to pay for equipment to bring the power level down to a usable 120 volts. Dr. Banda said that cost about $9,000.

Mr. Moore of Harrington suggested that the equivalent amount of water and electricity work in the United States would be hundreds of thousands of dollars.

Mr. Robert said, "Think about it. These people that live there have no clean water and no safe drinking water. It's just hard to believe."

Suggesting his giving wasn’t yet done, Mr. Robert said one of his next projects will be to make pond water in the village usable by installing a filtration system, "but I don’t have that organized yet,” Mr. Robert said. “I’ll have that done before the end of summer."

Mr. Robert said that his level of involvement in the project holds his interest. He asserted he has written checks to causes but wasn’t told what’s become of the project.

Dr. Banda said Mr. Robert "has been a godsend and I tell him all the time he has no idea what he’s done."

"It’s been so exciting,” she continued. “The village is ready to give us a big celebration when we get there. I wish Chris would have gone, but he wants to go when the hospital is opening, so the pressure is on."

Once the hospital is built, likely in a year, depending on donations, Harrington’s gift of beds and medical supplies from Harrington will come in handy.

In addition, Mr. Moore said, Harrington sent to Tanzania 107 extra T-shirts from a recent 5-kilometer walk the hospital held. It was after Dr. Banda mentioned the inhabitants’ clothing needs. They walk around in torn shirts without underwear, she said.

Mr. Robert, who also has a relationship with Day Kimball Hospital in Putnam, said he solicited the Connecticut facility to also send supplies to Tanzania.

Dr. Banda said donations of candy, drinks and supplies have been appreciated. Some people walk 60 miles or more to the clinic, and often they can't be served right away because there are usually only one or two doctors. "They wait for days,” she said, “and we can’t feed them and they're already malnourished. It’s sad. We give them candy or a Gatorade drink or Ensure. We can never feed everybody."

Once the hospital is completed, she said, Jambo Tanzania would like to give continual, subsidized care. But it will have to find funding. She suggested she would visit the hospital two or three times a year to make sure things are running smoothly.

In the meantime, the clinic has brought tremendous change and improvement, she said. “The kids are healthier and the people get the care,” she said.

The organization tries to give three months of supplies and instructs people to buy medication.
The doctor said she came to the United States from Tanzania at age 18. Because she did well in school, she said, her mother withdrew retirement money and purchased the future doctor a one-way ticket. She arrived with only a $100 traveler's check.

Upon her studies, she said, she went back to her country to see what its hospital and medical facilities looked like, and she found the conditions "just unbelievable."

She said she settled on the village because she wanted to go where “a little bit of my money could make a difference.”

She began taking supplies that were considered no good for U.S. hospitals, but were virtually new and usable to the village.

"When you go to see those people it’s so hard to not do something," she said.

India's Union Cabinet approve MoU with Tanzania for Traditional Medicine and Homeopathy

New Delhi, Jul 5 (PTI) The Centre today gave nod to the signing of a Memorandum of Understanding (MoU) between India and Tanzania for cooperation in the field of traditional medicines and homeopathy.

The Union Cabinet, chaired by Prime Minister Narendra Modi, also gave its approval for signing of an agreement for cooperation between India and Mozambique in combating illicit trafficking in narcotic drugs.

"The Union Cabinet has approved signing of a MoU between India and Tanzania in the field of traditional systems of medicine and homeopathy.

"The MoU will provide structured frame work for the cooperation between the two countries for the promotion and propagation of Indian traditional systems of medicine and homeopathy in Tanzania," an official statement said.

There will be no additional financial implications involved and the financial resources necessary to conduct research, training courses, conferences and meetings will be met from the existing allocated budget and existing plan schemes of AYUSH Ministry, it said.

India is blessed with well-developed systems of traditional medicine including medicinal plants, which hold tremendous potential in the global health scenario, while traditional medicine is an important element of life of Tanzanian people.

Tanzania on the other hand, is an important East African country and has historical ties with India. It also has a substantial population of around 70 thousand Indian diaspora.

Tanzania and India have traditionally enjoyed close, friendly and co-operative relations and in recent years, the relationship of the two countries have been marked by close contacts at the highest political level including cooperation in the field of health and medicine, the statement said.

The AYUSH Ministry has signed MoUs with several other countries which include China, Malaysia, Hungary, Bangladesh and Nepal.

The Union Cabinet also gave its approval for signing of a pact between India and Mozambique on drug demand reduction and prevention of illicit trafficking in narcotic drugs, psychotropic substances and precursor chemicals and related matters.

"The MoU is aimed to enhance mutual cooperation between the two countries in combating illicit trafficking in Narcotic drugs, psychotropic substances and their precursors through exchange of information, expertise and capacity building," the statement added.

Smokey Robinson honored with national pop music prize

WASHINGTON (AP) -- Whether he was singing his own compositions or writing for other artists, Smokey Robinson was instrumental in shaping the Motown sound that changed American popular music in the 1960s. Now, his accomplishments have won him the pop music prize from the national library.

The Library of Congress announced Tuesday that Robinson, 76, is this year's recipient of the Gershwin Prize for Popular Song. The lifetime achievement award is named for the duo of George and Ira Gershwin and was created by Congress to honor songwriters who entertain, inform and inspire. Past recipients include Billy Joel, Paul McCartney, Willie Nelson and Stevie Wonder.

Robinson has writing credits on more than 4,000 songs, and was behind some of the biggest hits in Motown history. As the lead singer of the Miracles, he wrote and performed "You've Really Got a Hold on Me," ''The Tracks of My Tears" and "I Second That Emotion." He also wrote some of the Temptations' best-known songs, including "My Girl," ''Get Ready" and "The Way You Do the Things You Do."

"It gives me such joy and gratitude to be included among the past recipients of this most prestigious songwriting award," Robinson said in a statement.

Robinson still performs regularly and was in Washington on Monday night as part of the lineup for annual "Capitol Fourth" concert on the lawn of the Capitol.

Born in Detroit, Robinson collaborated closely with Motown founder Berry Gordy, working as a producer and talent scout in addition to his songwriting duties. He was the label's vice president for nearly 30 years.

In addition to the Temptations, he wrote for Marvin Gaye, Brenda Holloway and the Marvelettes, among others, and the Beatles, the Rolling Stones and Michael Jackson are among the artists who've cited him as an influence.

"His rich melodies are works of art - enduring, meaningful and powerful. And he is a master at crafting lyrics that speak to the heart and soul, expressing ordinary themes in an extraordinary way," acting Librarian of Congress David Mao said in a statement. "It is that quality in his music that makes him one of the greatest poetic songwriters of our time."

Robinson will accept the prize in Washington in November.

Masami amesema kwamba ukusanyaji huu wa ufanisi umetokana na elimu iliyotolewa na Wizara kwa walipa kodi na kuwaandikia hati za madai wadaiwa sugu ambao walikuwa hawalipi kodi kwa wakati.

Kwa mujibu wa Masami mashauri 5000 yamefunguliwa ambapo Wizara imeshinda mashauri 2000 na imepewa hati ya kukamata mali ambayo ni deni la zaidi ya Tsh. bilioni 6 kati ya hizo zaidi ya bilioni 3 zimelipwa na wadeni wengine wanaendelea kulipa.

Aidha, amewataka wamiliki wote wa ardhi kulipa kodi kwa wakati na kwamba kodi ya ardhi hulipwa kila ifikapo Julai 1 ya kila mwaka katika Halmashauri, Manispaa na Makao Makuu ya Wizara na kuongeza kuwa kulipa kodi ni wajibu wa kila mmiliki kwa mujibu wa kifungu cha 33(1) cha sheria ya Ardhi Na. 4 ya mwaka 1999.

Tumewaita hapa leo ili tuwapatieni taarifa ya utekelezaji wa mpango wa kuzuia simu bandia za kiganjani zisitumike kwenye mitandao ya simu hapa nchini.

Kama ambavyo mnakumbuka, usiku wa tarehe 16 Juni 2016 simu bandia zilizuiwa kutumika katika mitandao ya simu. Maagizo ya Serikali kuzuia matumizi ya simu bandia kwenye mitandao ni sehemu ya mpango wa kuanzishwa kwa rajisi kuu ya Namba Tambulishi za simu za mkononi, kwa kifupi CEIR ambayo ni Central Equipment Identification Register.

Uthibiti wa matumuzi ya simu katika mitandao ya mawasiliano kunatokana na kuongezeka kwa umuhimu wa simu na vifaa vya mkononi vya mawasiliano kama nyenzo muhimu kimaisha, kijamii, kiuchumi, na kiusalama.

Vifaa vya mkononi vya mawasiliano ambavyo vinatumia laini ya simu, yaani SIM card kuwasiliana vina namba maalum inayoitambulisha, ambayo inaitwa IMEI – kifupisho cha International Mobile Equipment Identity.

Mfumo wa Rajisi kuu ya Namba Tambulishi ni wa kielektroniki na unahifadhi kumbukumbu za namba tambulishi za vifaa vya mawasiliano vya mkononi (IMEI). Lengo la Rajisi ni kufuatilia namba tambulishi za vifaa vinavyoibiwa, kuharibika, kupotea au ambavyo havikidhi viwango (bandia) vya matumizi katika soko la mawasiliano.

Kuanzishwa kwa Mfumo wa Rajisi kuu ya Namba Tambulishi kunatokana na matakwa ya kisheria, ikiwemo masharti ya vifungu vifungu vya 84 hadi 90 vya Sheria ya Mawasiliano ya Kielektroniki na Posta ya 2010 na Kanuni za Namba Tambulishi (Central Equipment Identity Register) za mwaka 2011. Sheria na Kanuni vinaipa Mamlaka ya Mawasiliano Tanzania nguvu ya kusimamia kwa karibu vifaa vya kielektroniki vya mawasiliano vyenye namba tambulishi.

Sheria na Kanuni hizi zinawataka watoa huduma za simu za kiganjani kuwa na Mfumo wa ndani wa Rajisi ya Namba za Utambulisho wa simu za kiganjani yaani ‘Equipment Identity Register’ kwa kifupi EIR katika mitandao yao. Mifumo hii imeunganishwa na Rajisi Kuu iliyoko hapa TCRA.

Aidha Sheria inawataka watumiaji kusajili IMEI za vifaa wanavyotumia.

Mfumo huu una faida zifuatazo:-
  • Kuongeza usalama mtandaoni kwa watumiaji wa simu, kwani simu zote za kiganjani zitakuwa zinajulikana;
  • Kuzuia matumizi ya simu zisizokuwa na viwango hivyo kuepuka madhara yatokanayo na simu zisizokuwa na ubora stahiki;
  • Kuthibiti wizi wa simu. Iwapo mtu atapoteza au ataibiwa simu ya kiganjani na akatoa taarifa kwa mtoa huduma, simu hiyo tafungiwa isiweze kutumika kwenye mtandao mwingine wowote wa simu za kiganjani;
  • Kuhimiza utii wa sheria: Kifungu cha 128 cha EPOCA kinamtaka mtumiaji wa simu kutoa taarifa ya kupotea au kuibiwa kwa simu au laini ya simu. Kifungu cha 134 kinayataka makampuni ya simu kutokutoa huduma kwa simu ambayo imefungiwa kama ilivyoelezwa hapo juu. 
  • Kujenga misingi ya matumizi ya simu halisi, zisizo bandia. Mtumiaji ataweza kutambua iwapo simu aliyo nayo inakidhi viwango, ni halisi na sio bandia.Hii pia itatoa fursa kwa wateja wa simu za kiganjani kupata bidhaa inayolingana na pesa walizotoa kununulia simu hizo. 
Uzimaji wa Simu

Usiku wa manane tarehe 16 Juni, 2016 simu ambazo zilikuwa hazina viwango (bandia) zilizimwa kwa kuzingatia uchambuzi wa kina uliofanyika ili kubaini namba tambulishi ambazo hazikuwa na viwango. Namba tambulishi ambazo zilikuwa hazina viwango ilikuwa ni asilimia 2.96 ya simu zilizokuwa zinatumika kwenye mitandao ya makampuni ya simu hapa nchini. Simu zilizokuwa na namba tambulishi ambazo zimenakiliwa, yaani duplicates zilikuwa asilimia 0.09 na asilimia 96.95 ilikuwa ni idadi ya namba tambulishi za simu halisi (genuine).

Hadi kufikia sasa idadi ya namba tambulishi ambazo hazikidhi viwango zimefikia 1,713,337.

Baada ya kukamilika kwa zoezi la kuzimwa kwa simu zenye namba tambulishi ambazo hazikuwa za viwango (invalid IMEIS) na namba tambulishi zilizonakiliwa (Duplicate IMEIs) hadi sasa idadi ya namba tambulishi zilizonakiliwa ambazo zimezimwa imefikia 117,389.

Uelewa wa wananchi umechangia kwa kiasi kikubwa katika kufanikisha mpango huu.

Kama mnavyokumbuka, Mamlaka ya Mawasiliano iliratibu na kuendesha mpango wa elimu kwa umma kuhusu rajisi kuu ya namba tambulishi nchini kote na kupitia vyombo vya habari kati ya 17 Desemba 2015 na 16 Juni 2016.

Katika kutelekeza mpango huu, tumekumbana na changamoto zifuatazo:-
  • Uaminifu mdogo kwa baadhi ya wauzaji wa simu kwa kutoa punguzo kwa wananchi ili kuwashawishi kuzinunua simu bandia kwa bei nafuu. Hata hivyo ni jambo la kutia moyo kwamba wananchi wengi hawakubali kudanganywa.
  • Gharama zinazohitajika katika kuwafikia wananchi na kuelimisha ili waweze kuelewa zaidi juu ya mpango mzima wa kuhakiki simu zao. Tanzania ni kubwa na hatukuweza kufika kila mahali kutokana na ufinyu wa bajeti. 
  • Baadhi ya watumiaji kutokufuata maelekezo ya namna ya kuhakiki simu zao katika kipindi cha mpito. Kwa mfano, wengi walikuwa wanakosea kutuma ujumbe wenye Namba tambulishi kwenda 15090.
  • Baadhi ya watumiaji kuamini kwamba simu bandia ni zile za bei rahisi au ambazo zimenunuliwa hapa nchini na hivyo kulalamika walipofungiwa simu walizonunua kwa bei kubwa na ambazo ni bandia.
  • Baadhi ya watoa huduma kushindwa kushughulikia malalamiko ya wateja waliofungiwa simu zao kwa wakati.
  • Mamlaka ya Mawasiliano Tanzania inaendelea kuwakumbusha watanzania wote kuwa ni jukumu la kila mmoja kuhakikisha kuwa simu yake ni halisi na sio bandia. Pia wananchi wanakumbushwa kutoshikilia simu zilizozimwa majumbani na kuzipeleka mahali husika kwa ajili ya ukusanyaji (disposal).
Vilevile Mamlaka inawakumbusha wauzaji wa vifaa vya mawasiliano vya mkononi na mafundi simu kuwa ni kosa kubadilisha namba tambulishi za vifaa vya simu za mkononi (mobile devices). Kwa mujibu wa kifungu cha 127 cha Sheria ya Mawasiliano ya Kielektroniki na Posta (EPOCA), mtu yeyote ambaye anachakachua simu au lani ya simu kwa lengo la kubadilisha uhalisia wake anatenda kosa ambalo adhabu yake ni faini isiyopungua shilingi millioni 30 au kifungo kisichozidi miaka kumi (10) au vyote kwa pamoja.

Aidha, kifungu cha 135 cha EPOCA kimeweka adhabu ya faini ya shilingi 1,500,000 au kifungo cha miaka mitano au vyote kwa pamoja kwa matu ambaye anachakachua simu iliyofungiwa.

Mamlaka ya Mawasiliano Tanzania inatoa wito kwa wale wote wote wanaofanya biashara za kuingingiza simu hapa nchini kutoka nje wahakikishe kuwa simu wanazoleta zinakidhi viwango, zimehakikiwa kwa mujibu wa wa Shirika la Viwango Tanzania.

Aidha Mamlaka inawakumbusha kwa mara nyingine kuwa wanapaswa kuwa na leseni ya Mamlaka ya Mawasiliano kwa mujibu wa Sheria. Hii pia ni kwa mafundi wote wa simu nchini, wanatakiwa kuanza mchakato wa kupata leseni ya kutengeneza simu, ikiwa ni pamoja na kuweka utaratibu wa kuwaorodhesha wanaoleta simu zao kutengenezwa ili kuepuka kuwa sehemu ya mtandao wa wizi wa simu.

Mamlaka ya Mawasiliano Tanzania inawashukuru wadau wote walioshiriki katika kufanikisha Mpango huu. Hao ni pamoja na makampuni ya simu za mkononi, jeshi la Polisi, Viongozi wa mikoa ambako elimu kwa umma ilitolewa, vyombo vya habari Tume ya Ushindani (FCC) pamoja na Shirika la Viwango Tanzania (TBS).

Uamuzi kuhusu makampuni ya simu yaliyokiuka masharti ya usajili wa namba/laini za simu

Tumewaita hapa leo ili kutoa uamuzi kuhusu mashauri ya ukiukwaji wa masharti ya usajili wa namba/laini za simu za mkononi uliofanywa na makampuni ya simu za mkononi.

Makampuni hayo ni:

1. Airtel Tanzania Limited,
2. Benson Informatics Limited ambayo inatumia jina la biashara la SMART,
3. MIC Tanzania Limited ambayo inatumia jina la biashara la TIGO,
4. Viettel Tanzania Limited ambayo inatumia jina la biashara la Halotel,
5. Vodacom Tanzania Limited,
6. Zanzibar Telecom Limited ambayo inatumia jina la biashara la Zantel.

Makampuni hayo yamekiuka masharti ya usajili wa laini na matumizi ya laini kama yalivyoaninishwa kwenye Sheria ya Mawasiliano ya Kielektroniki na Posta (EPOCA) ya 2010 na Kanuni za Mawasiliano ya Kielektroniki na Posta za Leseni za 2011.

Kabla ya kuelezea uamuzi huo, naomba kwanza nitoe maelezo ya awali kuhusiana na suala zima la usajili wa laini/namba za simu za mkononi.

Itakumbukwa kwamba usajili wa namba simu umekuwa ni wa lazima baada ya sheria ya EPOCA ya 2010 kuanza kutumika. Kifungu cha 102(1) cha EPOCA kinafafanua kwamba mtu yeyote ambaye anamiliki simu ya mkononi ana jukumu la kutoa taarifa kwa mtoa huduma ikiwa kutakuwepo na mabadiliko ya umiliki wa simu hiyo au namba iliyosajiliwa kwa jina lake. Kifungu 102 (2) kinamtaka yeyote ambaye atataka kutumia simu au namba ambayo ilikuwa inatumiwa na mtu mwingine kusajili simu na namba hiyo. Aidha Kanuni za Watumiaji (The Electronic and Postal Communications (Consumer Protection) Regulations 2011) na Kanuni za leseni (Licensing Regulations 2011) zina vipengele kuhusu usajili wa namba za simu.

Kanuni ya 10(2) ya Kanuni za watumiaji kinasema mtu yeyote ambaye anamiliki au ana nia ya kutumia laini ya simu au kifaa chenye laini ya simu ndani anatakiwa kujisajili kwa mtoa huduma au wakala aliyeidhinishwa.

Kanuni ya 33(1) ya Kanuni za leseni kinaeleza kwamba mtu yeyote ambaye anauza au kwa namna yeyote ile anatoa laini ya simu au kifaa chenye laini ya simu ndani anatakiwa kuandikisha wateja kwa kutumia fomu maalum ambayo inamtaka mtumiaji atoe kitambulisho chenye picha yake halisi.

Sababu za kuanzisha utaratibu wa kusajili namba za simu ni pamoja na:-

(i) Kuwalinda watumiaji na jamii kutokana na matumizi mabaya ya huduma za mawasiliano.

(ii) Kuwezesha kuwatambua watumiaji wa huduma za ziada za simu, kama huduma za kibenki, kutuma na kupokea fedha, kufanya malipo mbalimbali kwa kutumia simu kwa mfano kulipia huduma za maji, umeme, vipindi vya televisheni vya kulipia n.k.

(iii) Kuimarisha usalama wa taifa.

(iiii) Kuwawezesha watoa huduma za mawasiliano kuwafahamu vizuri wateja wao na kuwahudumia ipasavyo kadri ya mahitaji yao.

(v) Kuwa na taarifa za matumizi ya simu za mkononi kwa ajili ya mipango ya maendeleo ya sekta.

Mnamo Aprili 2013 Mamlaka ya Mawasiliano Tanzania na makampuni yanayotoa huduma za simu za mkononi walikubaliana juu ya hatua za kumaliza kasoro zilizokuwa zimejitokeza katika usajili wa namba za simu. Aidha walikubaliana kutokuwezesha laini/namba za simu kutumika kabla ya usajili kukamilika na taarifa za mteja kuhakikiwa.

Makubaliano mengine yalikuwa kwamba mitandao ya simu isifanye kile kinachoitwa ‘ usajili wa awali’.

Mamlaka ya Mawasiliano Tanzania inafanya ukaguzi wa mara kwa mara wa usajili wa namba za simu.

Hivi karibuni, Mamlaka ya Mawasiliano Tanzania imekagua mifumo ya usajili wa laini za simu na kugundua ukiukwaji katika maeneo manne:

1. Namba kutolewa bila mteja kutakiwa kusajiliwa.
2. Namba kusajiliwa kwa majina, vitambulisho na nyaraka za watu wengine.
3. Namba kutokufungwa hadi usajili ukamilike
4. Namba kusajiliwa usajili wa awali.
Makampuni sita ambayo yaligunduliwa kutenda makosa hayo yote au baadhi yaliitwa na MamKatulanda Fred1:
laka ya Mawasiliano Tanzania tarehe 2 na 3 Juni 2016 na kutakiwa kutoa utetezi wao kuhusu ukikwaji wa masharti ya Usajili wa namba za simu za mkononi.

Kufuatia kusikilizwa kwa mashauri hayo, Mamlaka ya Mawasiliano Tanzania ilifikia uamuzi ufuatao kwa kila kampuni ya simu za mkononi husika:


Baada ya kusikiliza utetezi wa Mtoa Huduma kwa maelezo ya mdomo na maandishi, na baada ya kuzingatia utetezi huo, ni wazi kwamba Mtoa Huduma amekiuka kanuni ya 33 ya Kanuni za Leseni za mwaka 2011 zilizotolewa chini ya Sheria ya Mawasiliano ya Kielektroniki na Posta (EPOCA) na pia amekiuka vifungu 93,130 na 131 vya Sheria hiyo.

Kwa kuzingatia kwamba ni wajibu wa Mtoa Huduma kuhakikisha kwamba uuzwaji na utoaji wa laimi za simu unafanyika kwa mujibu wa kifungu 93 (2,3 na 4) cha Sheria ya Mawasiliano ya Kielektroniki na Posta ya 2010, na Kanuni ya 33 ya Kanuni za Leseni za 2011 na kwamba Mtoa Huduma amekiuka matakwa ya Sheria; na

KWA KUTAMBUA KWAMBA matumizi mabaya ya laini/ namba za simu za mkononi kunahatarisha usalama wa Taifa na kunachochea tabia hatarishi katika jamii na kunaendeleza tabia za kiuhalifu nchini;

KWA HIYO BASI, Mamlaka inatoa AMRI kama ifuatavyo:

1. AIRTEL TANZANIA LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 74,000,000 (shilingi za Kitanzania Milioni Sabini na Nne) kwa kuruhusu kuuzwa kwa laini 148 bila kutumia kitambulisho halisi cha mnunuzi.

(b) SHILINGI 33,500,000 (shilingi za Kitanzania Milioni thelathini na tatu na laki tano) kwa kuruhusu laini 67 ziuzwe bila kujaza fomu ya usajili.

(c) SHILINGI 32,500,000 (shilingi za Kitanzania Milioni thelathini na mbili na laki tano) kwa kuruhusu laini 65 ziwashwe kabla ya kuuzwa; na

(d) SHILINGI 42,500,000 (shilingi za Kitanzania Milioni arobaini na mbili na laki tano) kwa kuruhusu laini 85 zifanyiwe usajili wa awali na kutumika kwenye mtandao wake.

2. BENSON INFORMATICS LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 7,000,000 (shilingi za Kitanzania Milioni Saba) kwa kuruhusu kuuzwa kwa laini 14 bila kutumia kitambulisho halisi cha mnunuzi.

(b) SHILINGI 7,000,000 (shilingi za Kitanzania Milioni Saba) kwa kuruhusu laini 14 ziuzwe bila kujaza fomu ya usajili; na
(c) SHILINGI 3,000,000 (shilingi za Kitanzania Milioni Tatu) kwa kuruhusu laini 6 ziwashwe kabla ya kuuzwa.

3. MIC TANZANIA LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 93,500,000 (shilingi za Kitanzania Milioni Tisini na Tatu na Laki Tano) kwa kuruhusu kuuzwa kwa laini 187 bila kutumia kitambulisho halisi cha mnunuzi;

(b) SHILINGI 43,500,000 (shilingi za Kitanzania Milioni Arobainii na tatu na laki tano) kwa kuruhusu laini 87 ziuzwe bila kujaza fomu ya usajili;

(c) SHILINGI 41,000,000 (shilingi za Kitanzania Milioni Arobaini na Moja) kwa kuruhusu laini 82 ziwashwe kabla ya kuuzwa; na

(d) SHILINGI 11,000,000 (shilingi za Milioni Kumi na Moja) kwa kuruhusu laini 22 zifanyiwe usajili wa awali na kutumika kwenye mtandao wake.

4. VIETTEL TANZANIA LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 36,500,000 (shilingi za Kitanzania Milioni Thelathini na sita Laki Tano) kwa kuruhusu kuuzwa kwa laini 73 bila kutumia kitambulisho halisi cha mnunuzi.

(b) SHILINGI 36,000,000 (shilingi za Kitanzania Milioni Thelathini ba Sita) kwa kuruhusu laini 72 ziuzwe bila kujaza fomu ya usajili; na

(c) SHILINGI 34,500,000 (shilingi za Kitanzania Milioni Thelathini na Nne Laki Tano) kwa kuruhusu laini 69 ziwashwe kabla ya kuuzwa.

5. VODACOM TANZANIA LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 49,000,000 (shilingi za Kitanzania Milioni Arobaini na Tisa) kwa kuruhusu kuuzwa kwa laini 98 bila kutumia kitambulisho halisi cha mnunuzi;

(b) SHILINGI 24,000,000 (shilingi za Kitanzania Milioni Ishirini na Nne) kwa kuruhusu laini 48 ziuzwe bila kujaza fomu ya usajili;

(c) SHILINGI 19,000,000 (shilingi za Kitanzania Milioni Kumi na Tisa) kwaKatulanda Fred1:
kuruhusu laini 38 ziwashwe kabla ya kuuzwa; na

(d) SHILINGI 4,500,000 (shilingi za Milioni Nne na Laki Tano) kwa kuruhusu laini 9 zifanyiwe usajili wa awali na kutumika kwenye mtandao wake.

6. ZANZIBAR TELECOM LIMITED ilipe kwa Mamlaka,ifikapo 30 Julai 2016 faini kama ilivyoainishwa hapa:

(a) SHILINGI 36,500,000 (shilingi za Kitanzania Milioni Thelathini na sita na Laki Tano) kwa kuruhusu kuuzwa kwa laini 73 bila kutumia kitambulisho halisi cha mnunuzi;

(b) SHILINGI 11,500,000 (shilingi za Kitanzania Milioni Kumi na Moja na Laki Tano) kwa kuruhusu laini 23 ziuzwe bila kujaza fomu ya usajili;

(c) SHILINGI 7,000,000 (shilingi za Kitanzania Milioni Saba) kwa kuruhusu laini 14 ziwashwe kabla ya kuuzwa; na

(d) SHILINGI 2,000,000 (shilingi za Milioni Mbili) kwa kuruhusu laini 4 zifanyiwe usajili wa awali na kutumika kwenye mtandao wake.

Pamoja na faini hizi, Watoa huduma hawa wametakiwa kuchukua hatua zifuatazo:

a) Kuwasilisha Mamlaka a Mawasiliano Tanzania ifikapo 15 Julai 2016 orodha iliyohakikiwa ya wakala wa kusambaza na kuuza laini za simu nchi nzima kama inavyotakiwa na kifungu 92(2) cha EPOCA;

b) Kuacha mara moja kuwatumia wakala au wasambazaji wasioruhusiwa kuuza au kusambaza laini za simu nchini;

c) Kuhakikisha kwamba laini za simu zinauzwa na Wakala anayetambuliwa na Mtoa Huduma na ambaye ana anwani ya makazi inayofikika na pia mwenye Namba Tambulishi ya Mlipa Kodi (Tax Payer Identification Number); na

d) Kuzima laini zote zilizo sokoni ambazo zimewashwa na kuwasilisha taarifa ya utelekezaji wa Mamlaka ya Mawasiliano Tanzania ndani ya siku saba kutoka tarehe walizopokea Uamuzi huu.

Mtoa Huduma yoyote atakayekaidi utekelezaji wa AMRI atachukuliwa hatua kali za kisheria ikiwa ni pamoja na kushtakiwa kwa makosa ya jinai.

Mwisho, napenda kumalizia uwasilishaji wa uamuzi huu kwa kusisitiza yafuatayo:

Utaratibu wa kusajili laini za simu za mkononi unawahusu watoa huduma na watumiaji pia. Watumiaji, watoa huduma, wakala wa makampuni ya simu za mkononi na wananchi kwa ujumla wanakumbushwa kwamba ni kosa kisheria kutumia au kuwezesha kutumiwa kwa namba ya simu ambayo haikusajiliwa.

Ni kosa la jinai kutumia namba ya simu isiyosajiliwa. Adhabu ni faini ya shilingi laki Tano au kifungo cha miezi mitatu. Kusajili nenda kwa mtoa huduma wako au wakala wake ukiwa na kitambulisho chenye picha yako. Toa taarifa sahihi.

Aidha ni kosa kusajili laini kwa kutumia majina yasiyo sahihi.

Mtuhumiwa wa ujambazi na mauaji msikitini Mwanza atoroka

WATUHUMIWA wawili wa ujambazi waliokuwa wakihusishwa na mauaji ya wauamini watatu katika Msikiti wa Rahman pamoja na unyang’aji katika maduka ya M-Pesa, Tigo Pesa na Airtel Money, Hamis Juma (38) mkazi wa Nyegezi ametoroka akiwa chini ya ulinzi wa polisi na mwingine Mohamed Bishof au Gunda Mika (31) amefariki dunia.

Mtuhumiwa huyo anadaiwa kuwatoroka polisi Julai 3, mwaka huu majira ya saa 2:00 usiku katika eneo la mlima wa Kiloreli Nyasaka katika Manispaa ya Ilemela.

Kwa mujibu wa Kamanda wa Polisi wa Mkoa wa Mwanza Ahmed Msangi, mtuhumiwa huyo aliwatoroka askari wa upeleelzi ambao aliwapeleka katika mlima huo kwenda kuwaonyesha maficho majambazi wenzake wanayotyatumia kujificha.

Alisema baada kufika eneo hilo majambazi wenzake walishituka na kuanza kufyatua risasi askari hao ambao walitaharuki na kisha kujibu mashambulizi hayo. Msangi alieleza kuwa wakati majambazi na askari wakiendelea kujibizana kwa kurushiana risasi mtuhumiwa huyo Juma alitumia mwanya huo kuwatoroka polisi na kutokomea usiku huo.

Katika mapambano hayo askari waliambulia kupata risasi iliyokuwa moja ikiwa kwenye chemba ya bunduki hiyo moja aina ya Short Gun iliyokatwa mtutu na kitako chake wake ambayo ilikuwa ikitumiwa na majambazi hao baada ya kuitupa na kutokomea ambapo msako na juhudi kubwa zinafanyika za kumsaka mtuhumiwa huyo.

Aidha, katika tukio jingine mtuhumiwa mwingine wa matukio hayo ya uporaji na mauaji ya waumini wa dini ya Kiislamu, Mohamed Bishof au Gunda Mika (31) shombe wa Kiarabu amefariki dunia kutoka na majeraha aliyoyapata baada ya kuruka kutoka kwenye gari la polisi.

Mtuhumiwa huyo aliruka kutoka ndani ya gari hilo katika eneo la Kiloreli Nyasaka kwa nia ya kutoroka ambapo alianguka barabarani na kuumia kichwani na sehemu mbalimbali za mwili wake na alifariki wakati akikimbizwa katika Hospitali ya Rufaa ya Mkoa wa Mwanza ya sekou Toure kwa matibabu. Mtuhumiwa huyo katika mahojiano na polisi alikiri kufanya uhalifu wa unyang’anyi wa kutumia silaha kwenye maduka ya kutoa huduma za kifedha pamoja na mauaji n wakati anakamatwa alikutwa kakiwa na vifaa vay kielektroni (electronic divice) alivyokuwa akivitumia kufanya uhalifu jijini na nje ya Jiji la Mwanza

Pia alikutwa akiwa na kompyuta mpakato waliyopora katika tukio la uporaji la Mei 5, mwaka huu huko Kishiri Centre mali ya Phares Gabriel ambaye walimjeruhi mguuni kwa kumpiga risasi na kupora kiasi cha fedha kisichojulikana.

MTUHUMIWA wa mauaji ya watu watatu ndani ya Msikiti wa Rahmani eneo la Ibanda relini, ametoroka akiwa chini ya ulinzi wa polisi katika mlima wa Kiloleli eneo la Nyasaka wilayani Ilemela mkoani Mwanza.

Mtuhumiwa huyo ambaye pia anahusishwa na ujambazi katika maduka yanayojishughulisha na miamala ya fedha, alitoroka wakati alipowapeleka polisi kuwaonesha watuhumiwa wenzake walipojificha.

Akizungumza na waandishi wa habari ofisini kwake jana, Kamanda wa Polisi Mkoa wa Mwanza, Ahmed Msangi, alisema mtuhumiwa Hamisi Juma (38) mkazi wa Nyegezi alifanikiwa kuwatoroka askari wa upelelezi aliokuwa amewapeleka kuwaonyesha wahalifu wenzake walipojificha ndani ya mapango.

“Tukio hili lilitokea Julai 3, mwaka huu saa 2:00 usiku, mtuhumiwa, Hamisi Juma, akiwa chini ya ulinzi wa polisi wa upelelezi, aliwapeleka kuwaonyesha eneo jingine wanapojificha watuhumiwa wa ujambazi katika kilima cha Kiloleli-Nyansaka, baada ya kufika ghafla eneo la tukio majambazi waliokuwa wamejificha walifyatua risasi kuwashambulia askari.

“Askari wakiwa na taharuki na kuanza kujibu mashambulizi, mtuhumiwa alipata mwanya wa kuwatoroka askari, alielekea eneo jingine la mlima na kuwaacha askari wakiendelea kurushiana risasi.

“Tunaendelea kumsaka Hamisi na wenzake ambao walipata mwanya wa kukimbia kusikojulikana. Askari wetu walifanikiwa kukamata bunduki moja aina ya Shortgun iliyokatwa mtutu na kitako, ikiwa na risasi moja,”alisema.

Alisema polisi walifanikiwa kumkamata mtuhumiwa mwingine wa mauaji ya msikitini na ujambazi wa kutumia silaha kwenye maduka na vibanda vya miamala ya fedha, Mohamed Bishof (31) mkazi wa Nyasaka ambaye aliruka kutoka ndani ya gari la polisi na kuanguka barabarani kwa lengo la kutoroka ambapo aliumia kichwani na sehemu mbalimbali ya mwili wake.

“Mtuhumiwa Bishof alifariki dunia akiwa njiani wakati anapelekwa hospitali kupatiwa matibabu. Wakati wa uhai alipohojiwa alikiri kushiriki matukio ya mauaji ya watu watatu katika msikiti wa Rahman na matukio ya unyang’anyi kwenye maduka ya fedha.

“Huyu tulimkamata akiwa na kompyuta mpakato (Dell) ambayo aliipora kwenye tukio la ujambazi Kishiri Center Mei 5, mwaka huu,” alisema.

Mkuu wa Wilaya azuia mikutano ya kisiasa wilayani kwake

MKUU wa Wilaya Iringa, Richard Kasesela amesema kamati yake ya ulinzi na usalama haitaruhusu mikutano ya hadhara itakayoombwa na vyama vya siasa wilayani humo ili kuipa serikali na wananchi nafasi ya kujiletea maendeleo baada ya kumaliza salama Uchaguzi Mkuu wa 2015.

Pamoja na uamuzi huo, Kasesela amesema kamati hiyo itawasaka na kuwafikisha katika vyombo vya dola watu wanaomkashifu Rais Dk John Magufuli na viongozi wengine wa serikali, siasa na dini kwa namna yoyote ile.

“Tuendelee na majukwa ya utendaji, majukwaa ya mipasho ya siasa tupumzike ili tuiache serikali ifanye kazi zake,” alisema baada ya Mkuu wa Mkoa wa Iringa, Amina Masenza kuwaapisha wakuu wa wilaya za mkoa wa Iringa mapema jana.

Kasesela alisema uchaguzi wa 2015 ulimalizika salama kwa kumpata rais, wabunge na madiwani na kwamba kazi inayofanywa na Rais kwasasa ni kumalizia kuunda serikali yake.

“Kama tunataka mbwembwe za siasa majukwani aidha tusubiri uchaguzi wa serikali za mitaa au Uchaguzi Mkuu wa 2020,” alisema huku akivitangazia vyama vya siasa ruksa ya kufanya mikutano yao ya ndani akiahidi hawataiingilia kama itafanyika kwa amani.

Half of Mainland citizens do not know what has happened in Zanzibar since the last election
4 out of 10 think the re-elected President should be accepted as legitimate

5 July 2016, Dar es Salaam: Zanzibar was a hotbed of activity during and after the October 2015 general election. Election results were annulled, with the Chairman of the Zanzibar Electoral Commission citing “violations of electoral law.” A re-election was set for March 2016. These decisions outraged the opposition and raised very serious concerns among members of the international community. Opposition leaders and supporters boycotted the re-election in protest. The result was the Chama Cha Mapinduzi incumbent, President Ali Mohamed Shein, winning the re-election easily.

Despite these dramatic twists and turns, more than half of citizens on the Mainland (53%) report that they do not know what has happened in Zanzibar since the October elections. On the other hand 4 out of 10 citizens are aware that a re-election took place on 20 March 2016 (43%) and that the October election results were annulled (39%). The main message is that some Mainland citizens have some ideas about the events that took place (annulment and re-election) but most are not clear on what has been happening in the islands.

These findings were released by Twaweza in a research brief titled Union Affairs: citizens’ views on recent developments in Zanzibar. The brief is based on data from Sauti za Wananchi, Africa’s first nationally representative high-frequency mobile phone survey. The findings are based on data collected from 1,815 respondents across Mainland Tanzania (Zanzibar is not covered in these results) between 29 March and 12 April 2016.

Despite uncertainty about the unfolding events, Mainland citizens nonetheless have strong opinions on what should happen to resolve the crisis. Close to a majority (42%) think that the President elected on 20 March 2016 should be recognized as legitimate. A further 20% think that the 20 March 2016 re-election was the right step to resolve the crisis. It is interesting that these are both positions held by the ruling party and Union Government. There is far less support among Mainland citizens for more conciliatory or opposition focused solutions such as declaring the CUF presidential candidate, Seif Shariff Hamad, the winner of the original October election (14%), entering into another coalition government (13%) or even just holding talks to find a peaceful resolution (8%).

Mainland citizens’ overall assessment of events also reflects the ruling party’s position on the matter. A significant majority of 6 out of 10 adults agree with the cancelling of the original results (59%) and having a re-election (60%). However, Mainland citizens are somewhat sympathetic to the opposition position: a full 39% agree with the opposition’s boycott of the re-election.

Aidan Eyakuze, Executive Director of Twaweza, said “In every dispute there are two sides to the story. Sauti za Wananchi data clearly show that Mainland Tanzanians have largely absorbed the official line on the events that unfolded in Zanzibar. Yet they are aware that they are missing some of the story and many of them are supportive of the opposition’s actions in response to the annulment of the original vote and re-election. The Union government, and the Revolutionary Government of Zanzibar face a huge task: to unite citizens and drive progress forward together. A majority of mainland Tanzanians said they knew nothing of what happened in Zanzibar in October 2015. This is a worrying sign of weakness in our Union. If we want to protect and to strengthen it, we all have a duty to stay vigilant about developments in Zanzibar.
